• Usage Data: Anonymous metrics on how you interact with the App (e.g., features used, session duration) to help us improve performance and stability.3. How We Use Your Data: We use your data solely for the purpose of providing the App's services:
• Service Delivery: To securely store your logs and generate PDF reports upon your request.
• AI Summarization: We use third-party AI services (Google Gemini) to process your text logs into organized summaries.
• App Improvement: To fix bugs, analyze usage trends, and enhance App functionality.
• No Ad Selling: We do NOT sell, trade, or rent your personal data or care recipient notes to advertisers or third parties.4. Third-Party Services: We utilize secure third-party vendors to run the App. By using the App, you acknowledge that your data may be processed by:
• Supabase: For secure database hosting, authentication, and backend services.
• Google Gemini API: For generating text summaries and organizing reports.
• Apple App Store & Google Play Store: For processing subscription payments. We do not store your credit card information on our servers.5. Data Retention & Deletion: We retain your data only as long as your account is active. You have the right to:
• Access: View your data at any time within the App.
• Export: Generate PDF reports of your data.
• Delete: You may request the permanent deletion of your account and all associated data by using the "Delete Account" feature in the App Settings or by contacting us at [email protected].6. End-User License Agreement (EULA)This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and Alexandre Niederauer Azevedo ("Developer") regarding your use of the Caregiver Notes mobile application ("App").1. MEDICAL DISCLAIMER: CAREGIVER NOTES IS NOT A MEDICAL DEVICE. THE APP AND ITS AI-GENERATED SUMMARIES ARE PROVIDED FOR INFORMATIONAL AND ORGANIZATIONAL PURPOSES ONLY. THE DEVELOPER DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU HAVE READ IN THIS APP. IF YOU THINK YOU MAY HAVE A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR EMERGENCY SERVICES IMMEDIATELY.2. Grant of License: The Developer grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App solely for your personal, non-commercial purposes strictly in accordance with the terms of this Agreement.3. CRITICAL MEDICAL DISCLAIMER: Caregiver Notes is a personal organizational tool, NOT a medical device. By using the App, you explicitly acknowledge and agree that:
• The App does not provide medical advice, diagnosis, or treatment.
• The summaries and reports generated by the App are created by Artificial Intelligence and may contain errors, omissions, or inaccuracies.
• You will never rely on the App's data for medical decisions.
• You will always verify information with a qualified healthcare professional.
• In a medical emergency, you will contact emergency services (911 or local equivalent) immediately.3. User Accounts & Responsibilities:
• Security: You are responsible for safeguarding your account credentials.
• Accuracy: You are solely responsible for the accuracy of the notes and data you enter.
• Legal Use: You agree not to use the App for any illegal purpose.
• Consent: You represent that you have the necessary consent or legal authority to record information regarding the care recipient.4. Subscriptions & Billing:
• Subscription Fee: The App is offered on a subscription basis at $9.99 USD/month (or the equivalent in your local currency).
• Auto-Renewal: Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
• Cancellation: You must manage and cancel your subscription directly through your Apple ID or Google Play Account settings. The Developer cannot cancel subscriptions on your behalf.
• Refunds: All refund requests must be directed to Apple or Google, as they handle the billing transactions.5. Intellectual Property: The App, including its code, design, and original content, is the intellectual property of Alexandre Niederauer Azevedo. You retain full ownership of the text data and notes you enter into the App.6. Termination: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.7. Limitation of Liability: To the maximum extent permitted by applicable law, Alexandre Niederauer Azevedo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, errors in AI summaries, or any medical consequences arising from your use of the App.8.
